Madden recently obtained a defense verdict in the Circuit Court for Anne Arundel County on behalf of an obstetrician/gynecologist who was charged with perforating Plaintiff's bowel during laparoscopic surgery to remove an ovarian mass. Plaintiff presented to an emergency department five days after the surgery and was found to have a perforated sigmoid colon. Plaintiff sought damages for chronic pain and for years of lost wages. Goodell DeVries attorneys successfully established that the injury did not occur at the time of surgery, and that the surgical techniques used by the defendant physician were appropriate and within the standard of care. After a nine day trial, the jury found unanimously that the defendant physician had not acted negligently and judgment was rendered for the defense.
