Nichole Nesbitt and Ifeanyi Ezeigbo secured summary judgment for their hospital client in a premises liability matter involving a hospital visitor who claimed that the hospital allowed a hazardous condition to exist in its cafeteria by arranging the chairs too close together. The plaintiff fell and sustained serious injuries after the chair she was sitting on became entangled with another. The court agreed with the hospital’s position that the plaintiff failed to establish sufficient evidence that the hospital was aware of any hazardous condition caused by the arrangement of the chairs and that the hospital was in no better a position to notice a hazard than the plaintiff herself, who had visited the cafeteria many times in the days prior to the accident.
