Goodell DeVries Obtains Dismissal, Then Wins Appeal, in Medical Malpractice Lawsuit

Goodell DeVries prevailed on behalf of a Maryland hospital client in a medical negligence case. The plaintiff in the case filed two lawsuits, and our team successfully obtained dismissals in both. The plaintiff then filed an appeal in the second case. The Appellate Court of Maryland affirmed the dismissal, holding that the circuit court did not err in dismissing the complaint because of his failure to comply with the mandatory pre-suit requirements of the Health Care Malpractice Claims Act. The court also rejected the plaintiff’s attempt to avoid the statute of limitations by arguing that his second complaint should relate back to the earlier, defective filing.
