Goodell DeVries medical malpractice defense lawyers Marianne DePaulo Plant and James Phelan Robinson prevailed in a recent lawsuit on behalf of a hospital and an affiliated surgical group. The plaintiff experienced a surgical complication from laparoscopic cholecystectomy (gallbladder removal surgery) and alleged negligent surgical technique and negligent PACU nursing care. Her post operative pain was initially 10/10 and she claimed she should not have been discharged post operatively. Plaintiff returned to the hospital 12 hours later in respiratory distress and required protracted intubation and emergent surgery, and was airlifted to another hospital in Baltimore City for higher level care.
Goodell DeVries represented the local hospital and surgery group at trial with Ms. Plant delivering opening statement and Mr. Robinson delivering closing argument. The Goodell DeVries trial team collaborated with another defense firm representing the individual surgeon. The jury deliberated until 12:30 a.m. on October 23, 2024, and returned a verdict for all defendants. The jury unanimously concluded that both the surgeon and the PACU nurse complied with the standard of care.
