Medical Devices Manufacturer Successfully Defended Against Product Liability Claim

Richard M. Barnes and Matthew D. Kohel and obtained summary judgment for their client, a manufacturer of medical devices, in the United States District Court for the District of Maryland. In this product liability action, the plaintiff claimed that our client’s product was defectively designed and manufactured, and that it caused her significant neurological injuries when it struck her. Prior to summary judgment, Rick and Matt successfully excluded the plaintiff’s expert mechanical engineer for failing to employ a reliable methodology. They then moved for summary judgment, which the court granted because the plaintiff could not establish the existence of a defect or causation without expert opinion.
