On March 18, 2024, Goodell DeVries attorneys Amy Heinrich, Craig Brodsky, and Carrie Williams secured a victory for their healthcare client in the Appellate Court of Maryland. The team argued that the plaintiff’s medical malpractice claim must be dismissed because the required Certificate of Qualified Expert was deficient, which required dismissal of the plaintiff’s original complaint, and that the new complaint was filed outside the statute of limitations and must be dismissed as time barred. The appellate court’s opinion, which was issued only 11 days after oral argument, adopted the novel statutory interpretation argued by Amy, Craig, and Carrie, and affirmed the Circuit Court for Montgomery County’s July dismissal of the complaint.
