Goodell DeVries Prevails in Section 1983 Case

Goodell DeVries partners Kelly Hughes Iverson and Jhanelle Graham Caldwell obtained a jury verdict for the defense in the United States District Court for the District of Maryland on behalf of their client, a provider of correctional medical services. The plaintiff's allegations centered upon an alleged delay or denial of arthroscopy for a meniscal tear. The plaintiff contended that the defendant was deliberately indifferent to a serious medical need under 42 U.S.C. Section 1983, in violation of the Eighth Amendment's prohibition of cruel and unusual punishment. The defense team, however, demonstrated that the defendant timely approved both surgical and non-surgical options for the plaintiff in accordance with the U.S. Constitution. After brief deliberation, the jury returned a unanimous verdict for the defendant.
