Goodell DeVries attorneys Malcolm S. Brisker and David Shea successfully defended a corporate client in Frederick District Court against claims by a customer that the client had illegally sold his truck after he fell in arrears on payments to store it on the client’s property. David, with support from Malcolm, was able to secure judgment in favor of the client in a Monday morning bench trial after a postponement request agreed to by both parties was denied by the court just the Friday before and after an unsuccessful attempt at settling the case. Minutes before the outset of trial, Malcolm was able to secure, and relay to David and the client, the critical paperwork that showed the client had properly applied a mechanic’s lien to the truck, had given the proper notice to the plaintiff of the impending sale, and had properly publicized the truck’s auction so as to satisfy its duty under the law.
