Goodell DeVries attorneys K. Nichole Nesbitt and Bryan Cleary obtained a dismissal with prejudice of a complaint brought by a plaintiff asserting medical negligence and false imprisonment relating to his involuntary admission to the firm’s client, a behavioral health center. The court held that the client was legally justified in admitting the plaintiff to its care because the local police department filed a lawful application for emergency hospitalization. Although the plaintiff complained that the statements in the application were false, the court held that those statements were not attributable to the behavioral health center, and therefore the plaintiff had no basis to pursue his claims against the client.
