Goodell DeVries attorneys K. Nichole Nesbitt and Jhanelle A. Graham obtained a defense verdict in the Circuit Court for Baltimore City for their client, an orthopedic surgeon in Baltimore City. The plaintiff, a fellow orthopedic surgeon represented by William H. “Billy” Murphy, Jr. and Nicholas Szokoly of Murphy, Falcon & Murphy, alleged that he sustained a permanent ulnar nerve injury when his elbow collided with a surgical drill pin that the defendant was operating during a surgical procedure in which the two surgeons were concurrently replacing a patient’s left and right knees. The plaintiff claimed that the defendant failed to use reasonable care during the procedure. As a result of the alleged negligence, the plaintiff sought over $4 million in economic damages, as well as non-economic damages.
After an eight-day jury trial, the jury unanimously decided that the orthopedic surgeon represented by Goodell DeVries was not negligent and entered a defense verdict.
