Goodell DeVries’s Sean Gugerty Argues Appeal in Zantac MDL in Eleventh Circuit for Generic Defendants

Goodell DeVries partner Sean Gugerty recently delivered oral argument in the United States Court of Appeals for the Eleventh Circuit in Atlanta on behalf of all generic ranitidine manufacturers in the long-running in re Zantac MDL. The argument was presented to the three-judge panel in response to plaintiffs’ efforts to revive claims previously dismissed by a federal court in Florida.

Goodell DeVries has been embedded in this litigation for years, and the case has attracted national attention. Partner Rick Barnes is the liaison counsel on behalf of all generic Zantac manufacturers in the multi-district litigation, which has consolidated thousands of cases in the Southern District of Florida.

In July of 2021, Judge Robin Rosenberg of the United States District Court for the Southern District of Florida dismissed all claims without leave to amend on the grounds of federal impossibility pre-emption. Goodell DeVries attorneys Rick, Sean, and Kamil Ismail had prepared and argued the motion.

Since Judge Rosenberg’s ruling, plaintiffs have filed cases in multiple states. Sean has successfully moved to dismiss ranitidine cases and defended those victories on appeal in multiple states, including California and Illinois. His mastery of the relevant law and cases, his years of high-level work on these cases, his poise as an oral advocate, and his record of success position him well to argue against these appeals as they arise across the country.
