Goodell DeVries Obtains Defense Verdict for D.C. Hospital

Janet A. Forero and Joseph S. Johnston, together with John Hall of Hall Booth Smith, secured a unanimous defense verdict on behalf of a Washington, D.C. hospital following a medical malpractice jury trial that concluded on June 17, 2026. The case involved claims arising from the care of a child born prematurely at 28 weeks’ gestation who required extensive treatment and multiple airway interventions during a prolonged hospitalization. Plaintiff alleged that one of those interventions caused an injury affecting vocal cord function. The defense maintained that the child’s injury occurred in the context of the extraordinary, months-long efforts undertaken by the medical team to preserve the child's life and provide necessary care.

After less than three hours of deliberations, the jury returned a unanimous verdict in favor of the hospital, rejecting the claims against the institution. The verdict followed a multi-week trial involving complex medical and causation issues arising from the care of an extremely premature infant.
