After a two-week trial in the USDC for the Central District of California, Eastern Division, before Judge Jesus G. Bernal, Goodell attorneys, Thomas J. Cullen, Jr. and Kali Enyeart Book, obtained a defense verdict in favor of Crown Equipment Corporation, a leading manufacturer of material handling equipment. In Linares v. Crown Equipment Corporation, Plaintiff alleged serious injuries after a heel amputation suffered while operating a Crown stand-up rider forklift. Plaintiff presented theories of negligent maintenance, as well as design defect. Plaintiffs proceeded under the consumer expectation theory of design defect under California law. The jury deliberated for less than 45 minutes before returning a full defense verdict on both the design defect and negligent maintenance theories.
