Summary Judgment for Crown Equipment in Product Liability Case

Thomas J. Cullen, Jr., Kali Enyeart Book, and Alexander L. Stimac obtained summary judgment on behalf of Crown Equipment Corporation in a products liability case in the United States District Court for the District of New Jersey.  In McManus v. Crown Equipment Corporation, Plaintiff sought significant damages associated with an injury sustained while operating a Crown pallet jack.  Plaintiff asserted claims of negligence and strict liability against Crown, alleging that the pallet jack suffered from a manufacturing defect.  Crown moved for summary judgment on the grounds that plaintiff failed to prove the existence of a manufacturing defect under New Jersey’s indeterminate product defect test.  United States District Judge Brian R. Martinotti granted the motion, finding that plaintiff had failed to prove the existence of a manufacturing defect and thus failed to satisfy the indeterminate product defect test.
