In September 2017, Matthew D. Kohel prevailed on behalf of Dentsply Sirona Inc., one of the largest manufacturers of professional dental products in the world.
In Dentsply Sirona Inc., et al. v. L I K Supply Corp, et al., 3:16-cv-00806-MAD-DEP (N.D.N.Y. Sept. 29, 2017), Mr. Kohel obtained a permanent injunction and a damages award of $900,000 against three defendants in upstate New York. The defendants were found liable of willfully infringing 15 of Dentsply’s trademarks and of selling or advertising for sale counterfeits of Dentsply products. The defendants operated an internet-based counterfeiting operation in which they sourced counterfeits from China and then resold them throughout the United States and internationally on eBay and internet storefronts.
