Thomas V. Monahan, Jr.

PROFILE

Mr. Monahan is one of the founding partners of the firm. He has an extensive practice defending physicians, nurses, hospitals, nursing homes and related health care providers in medical negligence cases in Maryland, Virginia and the District of Columbia.

In addition to his professional malpractice practice, Mr. Monahan has maintained a general litigation practice, with experience in commercial litigation, insurance coverage, professional liability in non-medical professions, general personal injury litigation and the representation of licensed professionals before disciplinary boards. He recently represented a Fortune 500 company in a successful effort to recover substantial damages following the collapse of a pier in Baltimore Harbor.

Mr. Monahan has served as lead counsel or sole defense counsel in over 70 medical malpractice trials before juries in state and federal courts or before arbitration panels. Representative trials have included: the defense of brain-damaged baby cases involving allegations regarding the proper management of pre-natal and labor care, including the interpretation of fetal monitor tracings; a brain-damaged baby case alleging the failure to diagnose alloimmune thrombocy topenia; several cases regarding the proper diagnosis and treatment of cancer, including lung cancer, small bowel cancer, nasopharyngeal cancer and cancer of the tongue; a wrongful death case alleging the failure to diagnose and treat beta strep in a newborn; a wrongful death case involving the alleged failure to diagnose the cause of hemorrhaging in the throat of a 2-year-old boy; defense of a neurosurgeon accused of improperly treating an arterial venous malformation in the brain, a wrongful death case alleging the failure to diagnose injury to the innominate artery in a 15-year-old boy; two cases involving injuries to the common bile duct following laparoscopic gallbladder surgery; and three cases arising out of the suicide of psychiatric patients.

Lectured extensively to attending physicians, residents in training and nurses at hospitals in Maryland and Virginia on issues relating to medical malpractice.

Faculty Member of the Maryland Institute of Continuing Legal Education for programs relating to taking and defending depositions and current issues of health care law.

Guest lecturer on medical malpractice for the American College of Gastroenterology, Johns Hopkins Bayview Physicians, P.A., Columbia Medical Plan and Patuxent Medical Group.
